These Terms and Conditions (“Terms”) govern the use of the SmartersPro mobile application (“App”) provided by TECH SMARTERS Pvt Ltd (“TECHSMARTERS”,”SMARTERS”, “we”, “us”, or “our”). By installing, accessing, or using the App, including compatibility with M3U , JSON user-created playlists and in-app purchase subscription (“Subscription”) feature, you agree to these Terms. If you do not agree, please refrain from using the App and its features.

1. Subscription and Content Usage

a. The Subscription provides access to advanced features of the App, including content playback. It does not include the provision of any actual playlists or content.

b. The App is designed to work exclusively with user-created playlists that contain legal content. You are solely responsible for ensuring the legality of the content within your playlists.

2. User Responsibility

a. You are responsible for verifying that the playlists and contents you create, upload, or use within the App are legal and that you possess the necessary rights to use and, if applicable, record such content.

b. The Company is not liable for any misuse of copyrighted or third-party content accessed or used through the App. You must confirm that your contents are legal and that you hold the rights to use and, if applicable, record them.

3. In-App Purchase (IAP) Subscription

a. The Subscription includes the ability to use the App’s enhanced features for a one-year period from the date of purchase, which includes content playback. A 3-day trial period is offered at the beginning of the Subscription.b. During the trial period, you can access the full range of Subscription features, including content playback. If the Subscription is not canceled within the trial period, the Subscription fee will be charged to your designated payment method.c. Subscription automatically renews unless auto-renew is turned off at least 24-hours before the end of the current period.d. The account will be charged for renewal within 24-hours prior to the end of the current period, and identify the cost of the renewal.e. Subscriptions may be managed by the user and auto-renewal may be turned off by going to the user’s Account Settings after purchase.f. App store fees and taxes may apply and are your responsibility.

4. Content Playback

The App provides a platform to play content from user-created playlists, subject to the availability and compatibility of provided playlist URLs and content sources. The App does not host or provide any actual playlists or content.

5. Limitation of Liability

To the fullest extent permitted by law, the Company shall not be liable for any indirect, incidental, consequential, special, or punitive damages arising from the use of the App, Subscription, or content playback.

6. Acceptance

By using the App, including purchasing the Subscription, you acknowledge that you have read, understood, and agreed to these Terms.
